We want our own designs, photos and words protected, and we want to be sure that nothing we sell takes advantage of somebody else’s creativity, brand or likeness. This page explains who owns the content on https://pearltee.com, what you are welcome to do with it, what we ask you not to do, how we choose and check designs, and how to raise a trademark, design, publicity or other IP concern. Copyright takedown notices follow the specific process on our DMCA page.
\n
\n
The short version
\n
\n
The Pearltee name, our designs, product images and site text belong to Pearltee or to the creators who licensed them to us.
\n
Share links to our shirts as much as you like; please do not copy our designs or photos.
\n
We do not sell official merchandise or designs built on other people’s logos, characters or famous names.
\n
Report a concern to support@pearltee.com; we acknowledge within 1 business day and review within 5 business days.
\n
\n
\n
1. What Pearltee owns
\n
Unless a page says otherwise, everything on this site is owned by Pearltee or used with permission, including:
\n
\n
the Pearltee name, wordmark and any logo we use;
\n
the graphic designs printed on our T-shirts, and the digital previews and product photographs that show them;
\n
product names, product descriptions, category descriptions and the text of our policy and help pages;
\n
the site’s layout, graphics, icons and code written for Pearltee.
\n
\n
This material is protected by copyright, trademark and other intellectual property laws in the United States and in the other countries where we sell. Buying a shirt gives you ownership of that physical shirt; it does not transfer any rights in the design itself.
\n
2. What you are welcome to do
\n
\n
Share: post links to our product and category pages on social media, in messages or on your own site.
\n
Show off your shirt: take and share photos of yourself, your friends or your family wearing a Pearltee shirt. We love seeing them.
\n
Quote: quote a short extract from our pages with a link back to the original, for example in a review or a gift guide.
\n
Print for yourself: view or print our policy pages for your own records.
\n
\n
3. What we ask you not to do
\n
\n
Copy, download or reuse our designs, product images or descriptions on another store, marketplace, print-on-demand platform or social media shop.
\n
Print our designs on your own products, or create “inspired by” versions that reproduce the recognisable elements of a Pearltee design.
\n
Use the Pearltee name or anything confusingly similar in a store name, domain, advertisement or social account in a way that suggests you are us or connected with us.
\n
Scrape or bulk-download the site with automated tools, other than normal search engine indexing.
\n
Remove or alter copyright notices or other ownership information on our content.
\n
\n
If you would like to use our content in a way that is not listed in section 2, for example a feature in a publication or a collaboration, ask us first at support@pearltee.com. We are often happy to say yes.
\n
4. How we choose and check designs
\n
Every design in the Pearltee range is either created for Pearltee or used under a licence that allows it to be printed and sold on apparel. Before a design goes on sale, we look at it with a few questions in mind:
\n
\n
Does it include a brand name, logo, team crest, band name, film or TV character, or anything else owned by another business? If so, it does not go on sale.
\n
Does it use the name, face, signature or voice of a real, identifiable person? If so, it does not go on sale without that person’s permission.
\n
Does it closely resemble an existing artwork we know of? If we have any doubt, we do not use it.
\n
Is any phrase on it a registered trademark for clothing? We check common phrases before printing them.
\n
\n
Shared themes are fair game: campfires, sunsets, cats, coffee, holidays and puns belong to everyone. Specific expressions of those themes, such as a particular artist’s illustration, do not, and we treat them accordingly.
\n
5. Trademarks
\n
“Pearltee” is the name under which we trade, and we use it as a trademark for our clothing and our online store. Other names, brands and marks mentioned on the site, for example the names of carriers or payment providers in our policies, belong to their respective owners. Mentioning them does not mean they sponsor or endorse Pearltee, and it does not mean we are affiliated with them.
\n
Our category names, such as Music or Sports, describe the theme of the designs. They never mean that a shirt is official merchandise of a band, league or team; we do not sell licensed fan merchandise.
\n
6. Rights of publicity and real people
\n
Many places protect a person’s right to control the commercial use of their name, image and likeness. We do not sell shirts that feature real, identifiable people, including celebrities, athletes and public figures, without permission. If you believe a design on our site uses your name, image or likeness, or that of someone you represent, contact us using the steps in section 7 and we will review it as a priority.
\n
7. How to report an intellectual property concern
\n
For trademark, design right, publicity or other non-copyright concerns, email support@pearltee.com with the subject “IP concern”. To help us act quickly, please include:
\n
\n
your name, contact details and your relationship to the rights owner, for example owner, employee or legal representative;
\n
a description of the right involved, such as the trademark and its registration number and country, or a description of the protected design;
\n
the URL of each Pearltee page concerned and which element you are reporting;
\n
a short explanation of why you believe it infringes;
\n
a statement that the information you have provided is accurate and that you are authorised to act for the rights owner.
\n
\n
For copyright in artwork, photos or text, please use the process on our DMCA page, which asks for a few additional statements required by law.
\n
8. What happens after you report
\n
\n
How Pearltee reviews an intellectual property report
\n
\n
\n
Stage
\n
What we do
\n
Timing
\n
\n
\n
\n
\n
Acknowledge
\n
Confirm receipt and ask for anything that is missing
\n
Within 1 business day
\n
\n
\n
Review
\n
Compare the right you describe with the design or content on our site
\n
Within 5 business days of a complete report
\n
\n
\n
Resolve
\n
Remove or change the content, or explain why we believe no infringement exists
\n
At the end of the review
\n
\n
\n
Prevent
\n
Record the outcome so removed content does not return
\n
Ongoing
\n
\n
\n
\n
If a design is removed, we stop selling it right away, cancel and fully refund any unshipped orders for it, and will not restock it. We may ask follow-up questions before deciding; we never ignore a report because it is incomplete, we simply tell you what we still need.
\n
9. If you think a report against us is wrong
\n
We take every report seriously, but not every report is correct. If we believe a design does not infringe, for example because it uses a common phrase that is not protected for clothing, or a generic theme, we will explain our reasoning in writing and consider any further evidence you send. Nothing on this page limits anyone’s right to take a dispute to the appropriate authorities.
\n
10. Our content being used elsewhere
\n
It happens to every apparel brand: designs and product photos get copied onto other stores and marketplaces. If you see a Pearltee design or image being sold or shown somewhere that does not look like us, please tell us at support@pearltee.com with the link and a screenshot. Buying a shirt from a copycat site is also worth reporting to the platform or your card provider, because those sites rarely deliver the quality, sizing or returns you would get from us.
\n
11. Businesses, resale and photography
\n
You are free to resell a Pearltee shirt you bought, just as you could resell any piece of clothing you own, for example on a secondhand marketplace. What you may not do is present yourself as Pearltee, use our product photos in your listing as if they were your own stock, or reproduce the design on new shirts. Photographers, stylists and content creators may of course photograph people wearing Pearltee shirts; if you plan to use our name or designs in paid advertising, please ask first.
\n
12. Common questions
\n
Can I use a Pearltee design for my club’s T-shirts? Not by printing it yourself. If your group likes a design, order the shirts from us; our size run from S to 5XL covers most groups in one order.
\n
Can I post a photo of my Pearltee shirt and tag the design? Yes, please do. Sharing photos of a shirt you own is always welcome.
\n
Can I embed a Pearltee product image in my gift guide? Linking to the product page is always fine. If you would like to show the image itself in an article, email us first; we usually say yes as long as the image links back to the product and is not edited.
\n
I made something similar years ago. Is that infringement? Possibly, possibly not. Similar ideas often appear independently. Send us the details using section 7 and we will compare the works carefully.
\n
13. Ideas, suggestions and design requests
\n
We love hearing design ideas, and customers often suggest themes for future shirts. Please know that we develop many ideas internally and may already be working on something similar. If you send us an idea or suggestion, we may use it freely, without payment or obligation, but we will never publish your name or personal information without your permission. If you are a professional artist and want to discuss a licence, say so in your first email, and do not send finished artwork until we have agreed terms.
\n
14. Reviews and photos you submit
\n
If you submit a review or a photo, you confirm that it is your own work and does not infringe anyone else’s rights. Our Terms of Service explain the permission you give us to display it. We remove submitted content that infringes someone’s rights as soon as we are made aware of it.
\n
15. Permission requests and contact
\n
To request permission to use Pearltee content, or for any question about this policy, email support@pearltee.com or write to Pearltee, 1863 Barclay St, Maplewood, MN 55109, United States.
